This Certification Label is valid only when attached to a container or bag of
seed of the specified variety and lot number.
Ohio Seed Improvement Association (“OSIA”) is a nonprofit corporation
authorized by the laws of the State of Ohio to establish standards and
procedures for seed certification. The OSIA provides certification labels to
seed growers based upon the submission by growers to OSIA of representative
samples of seed for analysis of the genetic purity of the seed. The grower
and/or seller, by attaching this label to a particular lot of seed is
representing to both the OSIA and the buyer, that the seed has been produced,
conditioned and inspected in accordance with the standards and procedures
established by the OSIA and that the seed described on the label meets the
minimum requirements. THE GROWER AND/OR SELLER WHOSE NAME APPEARS ON OR IS
ATTACHED TO THE CONTAINER OR BAG OF SEED IS SOLELY RESPONSIBLE FOR THE SEED
ANALYSIS AND OTHER INFORMATION THEREON AND FOR THE PROPER USE OF THIS
CERTIFICATION LABEL.
OSIA IS NOT THE SELLER AND MAKES NO WARRANTIES, WHETHER EXPRESS OR IMPLIED
(INCLUDING THE IMPLIED WARRANTY OF MERCHANTIBILITY), AS TO THE SEEDS SOLD BY
GROWER OR SELLER. THE BUYER IS PURCHASING THE SEEDS “AS IS” WITH RESPECT TO
OSIA.

Application
for Inspection of Seed Crop, Inspection Agreement
Disclaimer
and Limit of Liability
Member hereby requests that the Ohio Seed Improvement Association
(hereinafter referred to as OSIA), the official seed-certifying agency
designated by the Ohio Department of Agriculture, inspect certain seed crops as
set forth in the member’s inspection request forms.
It is expressly agreed by the member that the inspection services hereby
requested to be provided by OSIA and its employees and agents, as provided by
law and by Ohio Seed Law No. 907.02 as amended, are limited to the following:
(a)
Visual field inspection for varietal
purity;
(b)
Visual field inspection for presence
of disease;
(c)
Visual field inspection for overall
crop management;
(d)
For post harvest testing (varietal
purity and diseases), inspection
shall be limited to visual inspection.
All inspections conducted by OSIA shall be based upon sequential
sampling methods pursuant to accepted inspection procedures.
Laboratory testing, when requested by the member or required or deemed
necessary by OSIA, shall be paid for by the member.
The member agrees to provide OSIA with complete and accurate records and
field maps as requested by OSIA. The
member also agrees to inform OSIA as to any changes in the conditions of the
crop which occur subsequent to the field inspection.
Failure of the member to meet these conditions shall render any
certification granted by OSIA void.
Visual field inspection approval does not guarantee that the crops will
be certified. Such approval only
means that the crops are eligible for subsequent steps in the certification
process as required by Ohio Seed Certification Regulations.
Certification from OSIA means that the SAMPLES INSPECTED are within the
tolerances for purity and disease as set forth in
Ohio
Seed Certification Regulations.
CERTIFICAITON DOES NOT CONSTITUTE A GUARANTEE OR WARRANTY, NOR IS IT A
REPRESENTATION THAT THE COMMODITY IS MERCHANTABLE OR FIT FOR A PARTICULAR
PURPOSE. THE CERTIFYING AGENCY
MAKES NO IMPLIED OR EXPRESS WARRANTIES OR REPRESENTATIONS AS TO FREEDOM FROM
DISEASE OR LEVEL OF QUALITY. CERTIFICATION
MEANS ONLY THAT, AT THE TIME OF INSPECTION, THE SAMPLED PLANTS AND/OR SEED OF
EACH
LOT
INSPECTED CONFORMED TO THE STANDARDS AND TOLERANCES AS SPECIFIED IN THE RULES.
It is understood and agreed that any liability of OSIA is limited to the
amount of the fees incurred by the member for the inspection.
